Terms of service

These terms are between DukanData ("DukanData", "we") and the business that opens a DukanData account ("you"). Opening an account, or using DukanData, is accepting them.

1. What DukanData is

DukanData is software to run a shop: billing at the counter, sales and purchases, stock, customers and suppliers, accounts and GST — used in a web browser and, at the counter, in an app for Windows. It is sold as a subscription, plan by plan.

2. Your account

• The account belongs to the business that opened it; the person who opened it is its owner in DukanData.
• Every login's mobile number is confirmed with a code. Keep passwords and PINs to yourselves: what is done with a login is taken to be done by its holder.
• You decide who in your shop gets a login and what each may do, and you answer for what they do with it.
• You must be 18 or over, and running a lawful business.

3. The free trial

A new account may use DukanData free for 14 days, with nothing to pay. There is one free trial for each mobile number.

4. Plans and paying

• The plans, what each holds and what each costs are on the pricing page, and inside DukanData under Plan.
• A plan is paid in advance — for one, three or six months, or a year — by UPI from inside DukanData. It starts, or runs on, once we have confirmed the payment, and you get a receipt for it, or a tax invoice where GST applies.
• Prices may change. A new price applies from your next payment, never to a period already paid for, and we tell you before it does.

5. When a payment is late

When a paid period or the trial ends, everything carries on for 7 more days while we remind you. After that the shop is paused: everything in it can still be opened and read, but nothing new is written until a payment is confirmed. Bills already made on a counter PC are never lost — they reach the shop all the same.

6. Your data

• The data you put into DukanData — items, stock, bills, customers, suppliers, accounts, and the files you upload — is yours. You let us keep it and work on it only to run DukanData for you.
• Every shop's data is kept apart from every other shop's. No other shop can see any of it.
• To help you, and to look into problems, DukanData's support staff may open your shop to look at it: read only, for a limited time, for a reason they write down, and with every page they open recorded. Support never changes anything in your shop's records. The privacy policy says more.
• You may ask for a complete copy of your data at any time — every table as a spreadsheet, every picture, a checksum for each — and DukanData support sends it to you, including while the shop is paused.

7. Your customers, and WhatsApp

• The details of your customers that you keep in DukanData are yours to look after: you answer for having their agreement to keep them and to send them bills and messages.
• When you link your shop's WhatsApp number, bills and messages go from that number, under WhatsApp's own terms. Do not use it to send messages people have not asked for.

8. What you must not do

• Use DukanData for anything unlawful, including false bills or false claims of tax.
• Try to reach another shop's data, or get round a limit of your plan or of DukanData.
• Attack, overload, copy or take apart the software, or resell it without our written agreement.

9. Tax, figures and advice

DukanData works out tax from the rates and settings you give it. The returns you file and the tax you pay are your responsibility — check them with your accountant. Nothing in DukanData is tax or legal advice.

10. Keeping it running

We work to keep DukanData running and your data safe, and we keep backups. The counter app keeps billing when the internet, or our servers, are away. We cannot promise that the service never stops, and we may pause it briefly to maintain it — at quiet hours wherever we can.

11. The limits of our liability

As far as the law allows, our whole liability to you in connection with DukanData is limited to what you paid us in the twelve months before the claim, and we are not liable for lost profit or for indirect loss.

12. Ending

• You may stop at any time; the plan is then simply not renewed. What was paid is refunded only as the refunds and cancellation policy says.
• We may pause or close an account that breaks these terms, or when the law requires it, and tell you why unless the law forbids it.
• After an account ends we keep its data for 90 days, so that you can come back or take a copy. After that it may be deleted for good.

13. When these terms change

We tell you inside DukanData or on WhatsApp before a change takes effect. Using DukanData after that is accepting the terms as changed.

14. Law and disputes

These terms are governed by the laws of India. A complaint goes first to our grievance officer; a dispute that is not settled goes to the courts where DukanData has its place of business.
